A registered trademark in India is valid for 10 years from the date of filing. It must be renewed every 10 years to maintain protection. Failure to renew results in the mark being removed from the register — leaving your brand exposed to copying and re-registration by competitors.

Renewal Timeline

  • Renewal can be filed up to 1 year before expiry (preferred)
  • Renewal can be filed within 6 months after expiry with surcharge (TM-12)
  • After 6 months post-expiry, the mark is removed from the register
  • Restoration possible within 1 year after removal — but costly and uncertain
